Hey, this is Chris, if you've been listening to this podcast you know that Todd has stepped back for the past few months to spend some much needed time with his family and work on some other business ideas. So when I got a text from Todd, I knew it was important. Burnham Law has decided to represent our military service members in the 3M earplug lawsuit not only Todd, but the entire staff at Burnham Law find it hard to believe that a company would knowingly send our service members to the frontlines with faulty equipment, and they take it personally if you want more information about this, just go to burnhamlaw.com slash 3M But now let's roll into the special episode of deep bench with Todd Burnham.
Todd Burnham 0:39
Hi, this is Todd Burnham. I am a licensed practicing attorney. But just because you're listening to me doesn't mean that I represent you. This is for informational purposes only if you're good with that, then let's roll.
Chris Braden 0:59
Season One was about how Todd Burnham started Burnham Law in his basement and built it to one of the most prestigious law firms in Colorado by thinking outside of the box and surrounding himself with the best lawyers and staff in the industry. Now during a pandemic Burnham Law is still growing. How you ask? You walk toward the storm and face it head on and you empower the people that help get you there. It's time to execute. It's time to make some lemonade. It's time to burn the ships. This is Deep Bench with Todd Burnham. Hey, Todd, how you doing, buddy?
Todd Burnham 1:37
I'm doing well. Chris, how are you man?
Chris Braden 1:39
Good. First of all, if you listen to this podcast, we all know that you're in Hawaii right now with the family. Well deserved. I won't say sabbatical because you're working on things.
Todd Burnham 1:51
Aw yeah it's no sabbatical man. It's definitely it's it's it's the best kind of work, watching and helping my kids develop. And just enjoying the time together while we're looking at the business and trying to grow it in the right ways. And overall, just making lemonade out of lemons, man.
Chris Braden 2:11
Exactly. So first of all, I guess my only question about why. How is it? Because I told you I've spent like a couple of weeks there. And I almost didn't come home I just adore not just being on the island, because obviously they're beautiful. But there's a different mindset.
Todd Burnham 2:28
That aloha spirit. Yeah, it's a the people are some of the most incredible people that I've ever met. Just honest, humble, proud people who love to share their culture and values, and we're immersed in it. And it's just a life altering experience for myself and my family. So I'm extremely appreciative and grateful.
Chris Braden 2:53
Yeah, not to mention, you get away from the snow for a little bit, which is nice.
Todd Burnham 2:56
It's a secondary, ancillary byproduct, that's a positive for sure.
Chris Braden 3:02
So I knew it was gonna take a lot to kind of drag you away from that, because I know you're working on a lot of things and spending tons of time with your family. But this is something close to your heart after talking to you, Stephanie Randall, and a lot of your staff there at Burnham Law, you're very invested. In this 3M case that's coming down, we've got a short window here for these plaintiffs to get involved with this action. So can you kind of explain what this is?
Todd Burnham 3:33
Yeah, so 3M has admitted some forms of liability. They provided defective earplugs to the military personnel. And they actually knew at some point that they were defective, and they continued to use them. So you have now what's called a mass tort, where everybody with the same types of claims will come together and file actions against one defendant. In this case, it's 3M. Okay. So what you do is you, you then have these initial cases that determine the ranges of damages. Okay. So it's really important that all you're doing at this point is getting your name in under the gun to make sure that you're part of the first group, the bellwether cases that that are, are going to be evaluated to determine ranges of damages. So it's super important in the beginning that you get in that first group. You don't want to be waiting, you have statute of limitations, issues that are arising and judges in at certain points, there's going to start looking and saying, Okay, that's enough for the first group. So get get these things get your claims in now, if you have them, and, and as you know, but me I'm all about value. That's the reason why we're doing this. There's, you can help a lot of people in a short window, and it just helps everybody to make sure that you're doing it the right way and As you know, with us, like we don't do, like these money grabs, we go after things, and we go to the bitter end, to make sure that people are made whole. And that's what we're doing here. And that's why I'm stopping what I'm doing and, and talking to you.
Chris Braden 5:12
The cool thing about Burnham Law is, obviously got offices in Boulder and Denver, but the office here in Colorado Springs has a huge military influence. I mean, the city was built on the military, you got Cheyenne Mountain, you got Fort Carson, you have Pete field, just to name a few. SpaceForce is located here. So the military is a big part of our city, I guess the thing I wanted to ask you is, how important is it to get the right representation when you're doing something like this, or working against a giant company in a suit like this?
Todd Burnham 5:51
I mean, how important is it that you get the right mechanic to fix your car, I mean, look, at the end of the day, everything is that we talk about is about value and making sure that, you know, your goals and your philosophies of how a case is handled is aligned with your own moral compass. Like so with us, the most important piece is value. And being successful in the outcome. Like we can talk the best game over everybody else. But at the end of the day, who's the best lawyer handling a case, we don't handle things the way like a lot of these big billboard firms do. You know, it's not just these aren't just numbers, these are people that we've invested our time and our hearts into. And we want to make sure that they move forward with their lives in the most advantageous way possible. And that means you you pick the right lawyers, and quite frankly, nobody does it the way that we do.
Chris Braden 6:44
Well, and I don't know about you, me being in the media and in radio for so long. Hearing is a big deal. Hearing is a huge deal. This isn't some some, you know, like we had Volkswagen with the emissions things a few years, this is affected people's lives. And I don't know about you, but tonight is hearing loss for those people that that entrusted us to put them out there with the right equipment to do their job. It's it's a personal thing.
Todd Burnham 7:13
It is and this isn't against the government or the military. This is against 3M they had a contract supply defective to supply earplugs, they provided defective earplugs, and they knew that they were defective at some point. That's not cool. It's just not okay. And so, for me when I see things like this, you know, this is the David versus Goliath type of deal where I love being on the right side of this. And right now we're just trying to get the word out, give us a call, get your claims in burnhamlaw.com/3M. And then we give you a lot of answers right there.
Chris Braden 7:53
So if you were actively deployed between 2003-2015 If you were issued these 3M dual ended Combat Arms earplugs and you've been not diagnosed with full partial hearing loss or tinnitus, or you know, you have it, you need to go to Burnham.com/3M. And they will definitely get on the case for you know what, I have to tell you, I come from a family of military people, and in the fact that a company knew that they were sending these people out there, these these men and women that are serving us with equipment that didn't work, you know, it's just wrong. It's just wrong. I don't know, what's what other way to to see it the moment they knew these words effective, they should have taken care of it in some way.
Todd Burnham 8:44
You know, it's it's fascinating to me that, that there are decision makers that would look at this and say that this is an acceptable loss for us. That's just quite frankly, that just pisses me off.
Chris Braden 8:57
Collateral Damage and stuff. Like they say in the movies all the time. There
Todd Burnham 9:01
it is. It's just and so they they got caught doing it. So this is a you know, I'm all about doing what's right and what's righteous. And this checks both boxes for me.
Chris Braden 9:13
Plus, not just you Stephanie Randall, all your staff of attorneys are amazing. I've met them all like, dude, they're gonna go to bat for you. They're gonna go to bat for you and, and I feel good about that. So, for me, putting this out there for the men and women of the military man, I just, you know, you just need to call Burnham Law and they'll take care of you.
Todd Burnham 9:34
Yeah, we're located in Colorado Springs in Briar Gate were part of the community we're not we're not just kind of like going into different areas that we don't know this is where we work. This is where we live. We have a vested interest in taking care of our own.
Chris Braden 9:47
Awesome. Hey Todd, anything last words you want to say about this?
Todd Burnham 9:51
Now, man, this just do the right thing. And if you you were, you know somebody that has been impacted by the use of these defective ear plugs, it doesn't, it doesn't take a lot to go on to the website and just investigate, do your research, look and see if there's other firms that that are handling it and you think that they'll do it better. It doesn't matter to me what matters most, we I know that we are the best at doing this. But you know, make sure that you have a comfort level, and that you've done your investigation. And so when you decide that you want Burnham Law handling these things, you have a comfort level and then it's you can focus on your family, you can focus on the things that matter to you. And if they think if you do that, you're going to have a little bit more peace of mind. And hopefully, within the next several months, this thing is going to be resolved. We're gonna start seeing 3M take responsibility the way they should have years ago.
Chris Braden 10:42
So right now we have until March 27. So if you've been affected by this, go to burnhamlaw.com/3M. The cool thing about Burnham Law is that when you contact Burnham Law, you get to talk to a person, which is really cool.
Todd Burnham 10:57
It's pretty cool that like, you know, the the gauge that we're setting is that you have to have human contact. Now, man, this is we we do things the right way, Chris, as you know, we've established you know, we have six offices throughout Colorado. And it's not because we're really good at marketing is because we're really good at winning. And that's our main focus right now is and always is making sure that we're doing things the right way. But we're successful in what we do. So I think that's a good business model. If you asked me.
Chris Braden 11:25
Hey, man, good job, brother. Hey, thanks for your time. Thanks for pulling away from the fam. I know they're literally in the next room waiting for dad to go surfing. I don't know what you guys are doing man.
Todd Burnham 11:37
Pretty close.
Chris Braden 11:38
Yeah. Anyway. Well, thanks, Todd. I appreciate it, buddy.
Todd Burnham 11:41
Aloha.
Hey, thanks for listening. Make sure you subscribe and until next time, keep getting better.
